LEGAL REQUIREMENTS

Batteries are now classed as Hazardous Waste.

The Special Waste Regulations 1996 combine with the existing Duty of Care and Health & Safety regulations and aim to ensure scrap batteries are disposed of safely and their valuable component parts, lead and polypropylene are recovered for recycling.

It is now an offence to allow the removal of scrap batteries from any premises unless the following requirements are complied with:

1) The carrier who collects the scrap must be
registered with the Environment Agency as a carrier
of controlled waste.

2) No scrap batteries can be removed from your premises without the official consignment note procedure being completed.

3) For each collection of scrap batteries you must have,and file a carrier schedule confirmation slip which must be kept for three years.

4) Under the Duty of Care you must be sure that the carrier is recycling the scrap. It is illegal to put scrap batteries into landfill sites or to dispose of them in any way other than via an authorised waste receiver and processor.

LEAD ACID BATTERIES
Lead acid batteries are listed on the Hazardous Waste List as entry 160601. They can be assessed against the various hazardous properties H1 - H14.
Lead acid batteries are classified as Special Waste.
SPECIAL WASTE OFFENCES
Special waste offences carry a heavier penalty than other waste offences and can include up to 5 years imprisonment.

The category of Special Waste is intended to cover the more harmful substances. As such, the Environment Agency is particularly vigilant regarding their disposal.
